# Terms of Service & Privacy Policy for Bailemos by Home Labs **Effective Date: April 12th 2026** Welcome to Bailemos, a mobile application developed by Home-Labs ("we", "us", "our"). Bailemos connects dancers with dance events and allows organizers to post their events. By using Bailemos, you agree to these Terms of Service and Privacy Policy. --- # Part 1: Terms of Service ## 1. Acceptance of Terms By creating an account or using Bailemos, you agree to be bound by these terms. If you do not agree, please do not use the app. ## 2. User Accounts - You must provide accurate information when creating an account - You are responsible for keeping your login credentials secure - You must be at least 16 years old to create an account - We reserve the right to suspend or terminate accounts that violate these terms or that we suspect of fraudulent or malicious activity ## 3. User-Posted Content Organizers may post event and class listings, including descriptions and poster images. By posting content on Bailemos, you: - Retain ownership of your content - Grant us a non-exclusive, worldwide license to display, distribute, and promote your content within the Bailemos platform - Agree that your content may be reviewed by automated moderation tools (see Privacy Policy, Section 6) - Are responsible for ensuring your content does not violate our community guidelines We may remove content that is inappropriate, explicit, offensive, promotes illegal or harmful behavior, or violates our community standards. ## 4. In-App Purchases and Tokens - Tokens are purchased through Apple App Store or Google Play and are subject to their respective terms - Tokens are used to promote events and classes within Bailemos - Tokens have no cash value and are non-transferable - **Refunds for promotion slots**: Slots that are still in "Scheduled" status may be cancelled and tokens refunded. Slots that are "Active" or "Completed" are not eligible for refund - Pricing for promotion slots may change at any time; the price at the time of purchase applies - We are not responsible for issues with payment processing — contact Apple or Google for payment disputes ## 5. Acceptable Use You agree not to: - Use Bailemos for any unlawful purpose - Post false, misleading, or spam content - Attempt to access other users' accounts - Interfere with the operation of the platform - Scrape, crawl, or collect data from Bailemos without permission ## 6. Service Availability Bailemos is provided **"as is"** without warranties of any kind. We do not guarantee: - Uninterrupted or error-free service - Accuracy of event listings posted by organizers - Availability of any particular feature We may modify, suspend, or discontinue any part of the service at any time. ## 7. Limitation of Liability To the maximum extent permitted by law, Home-Labs is not liable for any indirect, incidental, or consequential damages arising from your use of Bailemos. This includes, but is not limited to, missed events, incorrect event information posted by organizers, or loss of tokens due to technical issues. ## 8. Governing Law These terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of the Netherlands. --- # Part 2: Privacy Policy ## Information We Collect ### 1. Usage Data and Error Tracking (via PostHog) We use **PostHog**, an open-source analytics platform, to understand how users interact with Bailemos and to diagnose technical issues. PostHog helps us improve our app and user experience by collecting the following types of data: - Pages/screens visited - Buttons and features clicked - Events or classes viewed - Device type and browser version - Approximate location (country/city level) - Feature flag assignments (used to roll out new features gradually) - Application errors and crash reports, including technical stack traces, to help us identify and fix bugs This data **does not include personally identifiable information (PII)** unless you have signed in, in which case some events may be associated with your account. ### 2. Account Information If you register for an account, we may collect: - Name and last name - Email address - Date of birth - Gender (male, female, or other) - Country and country code - Dance type preferences and dancing role - Public profile setting (enabled by default — you can change this in your settings) - Marketing preferences and consent status - RSVP and attendance data for events and classes - Notification and settings preferences This data is used to personalize your experience and deliver features such as event notifications, friend connections, and optional newsletters. ### 3. Device Contacts (Mobile Only) With your **explicit permission**, the app may access your device's contacts (names, email addresses, and phone numbers) to help you find and connect with friends who also use Bailemos. - Contact data is used **only for matching** and is **not stored on our servers** - You can deny or revoke this permission at any time through your device settings without affecting the core functionality of the app - We track whether you grant or deny the contacts permission in our analytics to improve the feature experience ### 4. Social Features Bailemos includes social features that allow you to: - Follow and be followed by other users (friendships) - React to events and classes (e.g., "going", "like", "dislike") - View what events and classes your friends are attending Your profile is **public by default**, meaning other users can see your name and activity. You can change this in your account settings. Friendship relationships, reactions, and activity data are stored in our database and are subject to the data retention and deletion policies described below. ### 5. In-App Purchases If you purchase tokens through the app (for event promotion features), we store: - Transaction ID and platform (iOS or Android) - Product identifier - Purchase receipt data (for verification with Apple or Google) - Verification status and timestamp - Token balance We do **not** store your credit card number, payment method, or billing address. All payment processing is handled entirely by Apple (App Store) or Google (Google Play). We only receive and store the purchase receipt to verify the transaction and credit your token balance. ### 6. Content Moderation To maintain a safe and respectful platform, event and class descriptions and poster images submitted by organizers may be analyzed by **automated AI-based moderation services** (currently via OpenRouter) to check for content policy violations. - Only the content text and images are sent for analysis — **no personal information** is included - If content is flagged, it is removed from the listing; organizers are notified - If the moderation service is unavailable, content is accepted by default ### 7. Push Notifications (via OneSignal) We use **OneSignal** to deliver push notifications. When you enable notifications, the following data is shared with OneSignal: - Your user ID - Your user type (dancer or organizer) - Your email address You can manage your notification preferences in your account settings, including notifications for: - Favorite organizer activity - Favorite dance type events - Friend activity (events and classes your friends are attending) ### 8. Email Communications (via Resend) We use **Resend** to send transactional emails, including: - Account signup confirmations - Password reset emails - Account deletion confirmations These emails are sent using your email address and name. They are not marketing emails and are necessary for the operation of your account. #### Optional Marketing Emails With your **explicit consent**, we may send you: - Newsletters about upcoming events and classes - Announcements, updates, and curated content You can opt in or out of these communications at any time through your **account settings** or during sign-up. ### 9. Non-Registered User Tracking Even if you are not signed in, we may still collect non-personal usage data through PostHog, such as screen views and event interactions. When you delete your account, all associated database records (profile, friendships, reactions, purchases, token balances, promotion data) are permanently deleted via cascading deletion. - **Analytics data**: Usage events and error reports collected by PostHog may persist after account deletion, as they are stored in a separate analytics system. These events are not linked to your identity after account deletion. - **Purchase records**: Transaction receipts are retained for as long as your account exists and are deleted when your account is deleted. - **Device contacts**: Never stored on our servers — used only for in-memory matching during your session. ## Legal Basis for Processing (GDPR Compliance) We process your data based on: - **Consent**: For marketing emails, device contacts access, and personalized features - **Legitimate interest**: For improving the platform, monitoring performance, error tracking, and content moderation - **Contractual necessity**: When delivering core features tied to your account (e.g., in-app purchases, notifications) ## User Rights If you are located in the EU or EEA, you have the right to: - Access your data - Correct inaccuracies - Delete your account and data - Withdraw consent at any time - Object to certain types of processing - Request data portability To exercise these rights, contact us at [privacy@bailemos.app](mailto:privacy@bailemos.app). ## Data Security We use industry-standard practices to protect your data, including encryption, access controls, and secure third-party services.
